Cascade Harvest Classic Alpaca Auction

Sale terms and Conditions.

• I hear by enter the following Alpaca whose entry form are enclosed to the 2008 Cascade Harvest Classic Auction. Enclosed is my check in full for the entry fees (US funds). Once separate check per entry please, made payable to Cascade Llama Sales. If your animal is not selected for the sale your check will be returned. Once your animal is selected by the committee the fees are not refundable or transferable for any reason.

• I agree to pay 10% of the highest bid received whether I sell my alpaca or exercise my option to have the last bid and buy back my alpaca. I acknowledge that there is a minimum commission of $50 for the General sale and $100 on the Select and Premium sales. This commission will be deducted from my check which will be mailed once ALL of the checks from the sale clear (approximately 30 days).

• There is no “floor bid” at this sale. Consignors reserve the right to bid on and/or buy back their own animals at any price. Bidding on one’s own animal is their responsibility and should the owner or agent be the high bidder the 10% commission with $50-$100 minimum will still be enforced. Release papers will not be issued until commissions and/or animals are paid for.  

• Once my alpaca has been confirmed for this sale, no substitutions will be allowed without prior approval from Sale management. We plan on having no substitutions, but exceptions may be made if there is a valid reason in writing from your veterinarian. In the event that an animal is sold prior to the sale you agree to forfeit all of your entry fees, and also pay 10% of the selling price or a $100 fee (whichever is greater).

• All alpacas entered in the sale must have a veterinarian signed certificate of health stating that the animal is free from infection and contagious disease as well as meet any and all requirements for traveling into the state of Oregon. No animal will sell without a health certificate.

• In an effort to bring the best quality animals to buyers, you agree to declare any and all known irregularities and the auctioneer is hereby authorized to announce these at the sale. The sale management reserves the right to reject any alpaca that, in their judgment, is not up to the standard of the sale.

• All sales constitute a contract between the buyer and seller of each animal sold. Cascade Llama Sale, The Mumford Family, all other sale staff assume no responsibility, legal or otherwise, in regard to the sale contract. All warrantees and guarantees and strictly between buyers and sellers.

• Premium and Select consignments will sell in the same order as they are listed in the catalog, followed by the General Sale lots. The order of the general sale will be printed at the sale and on the Cascade Llama Sale website and will be available prior to sale day.

• The consignor agrees to hold The Mumford family, d/b/a Casecade Llama Sale harmless from damages in the event that unusual or unforeseen circumstances result in the change of location, change of time or date, or cancellation or similar modification of this sale.

• All Alpacas in the Premium and Select Sales must be ARI registered. Registration certificates must be signed by the legal owner or legal agent, and turned in to the sales office prior to the auction. A registration application is required on unregistered crias selling with their mothers.

• It is the consignor's responsibility to feed and water their own alpacas at the sale site, provide bedding, and make sure that their alpacas are brought to and shown in the sale ring and then returned to their stalls. Consignors must clean their own stalls. A $50 per stall fee will be issued to any consignor that does not leave the stalls as clean as they were at arrival. This fee can be deducted from your animal’s sale price. The consignor is to furnish the buyer with a halter.

• The highest bidder will be the buyer. In case of dispute, the sole authority to settle the bid rests with the auctioneer.

• I hereby authorize Cascade Llama Sale to accept payment for my entries at the sale and understand that they are under no responsibility to pay me for my entries until such time as the buyer has made satisfactory payment to them.

• Registration papers will be held by Cascade Llama Sale until the buyer's check clears the bank, whereupon papers will be sent directly to the buyer. The consignors will be paid by check less auction commission as soon as the buyer's check clears the bank.

• All liability for statements made in the sale catalog rest with the consignor. Please check the accuracy of your catalog statements.

• The sale management assumes no liability for loss or injury due to theft, mysterious disappearance, sickness, improper handling or act of God.

• Any dispute shall be resolved according to Oregon State law. The jurisdiction of any disputes shall be Jefferson County, Washington.
